Privacy Policy
How we collect, use and protect personal data in the course of party wall instructions.
Who we are
Andrew Edward & Co is a trading name of Party Wall Online Ltd. For the purposes of the UK GDPR and the Data Protection Act 2018, Party Wall Online Ltd is the data controller for personal data processed through this website and in the course of our instructions. Full company details appear in the footer of every page.
What we collect
Contact details you provide (name, address, email, telephone); information about the property and the proposed or completed works; correspondence with you, with the other owner's surveyor, and with third parties connected to the matter; photographs and survey records of the property; and, where relevant, payment and billing information.
Why we process it, and our lawful basis
To provide the surveying services you have instructed (performance of a contract); to discharge our duties under the Party Wall etc. Act 1996 (legal obligation); to respond to enquiries and provide estimates (legitimate interests); and to comply with our regulatory, insurance and record-keeping obligations to our professional body and to our professional indemnity insurers (legal obligation and legitimate interests).
Who we share it with
The other owner and their appointed surveyor, and the third surveyor where one is engaged, this is inherent in how the Act works, and a schedule of condition and Award necessarily record details of the property. We also use service providers for email delivery, document storage, e-signature and payments, each under a data processing agreement. We do not sell personal data and we do not use it for unrelated marketing.
How long we keep it
Party wall records are retained for at least fifteen years from the conclusion of the matter. That is long by design: latent damage from ground movement can appear years after works finish, and the schedule of condition and Award may be the only evidence of the position at the time. Enquiry records that do not become instructions are held for a materially shorter period.
Your rights
You may request access to your personal data, rectification of inaccuracies, erasure, restriction of processing, portability, and you may object to processing carried out on the basis of legitimate interests. Some rights are qualified where we are required to retain records for legal or regulatory reasons. To exercise any of them, contact us at hello@andrewedward.co.uk. You also have the right to complain to the Information Commissioner's Office at ico.org.uk.
